Purchase & Refund Policy

Before purchasing a Userve product, it's important to understand the Purchase & Refund Policy terms and conditions.

Payment

  1. By completing a payment on our website, you are confirming that you accept this Purchase & Refund Policy (and any future modifications thereof) and agree that you authorise your financial institution to initiate full payment for the products and/or services ordered.
  2. Payment in full is due at the time of purchase unless you select a supported deferred payment option (if available).
  3. Acceptable online payment methods are those made available on the checkout page at the time of purchase.
  4. Payment terms and conditions:
    1. When you complete the online payment form, funds will be deducted from your payment method in Canadian dollars (CAD).
    2. Payments are debited to Userve.
    3. Payments are secure:
      1. Payments will be processed using Secure Sockets Layer (SSL) technology.
      2. Credit card numbers are protected with a high level of encryption when transmitted over the internet.
      3. Userve does not have access to your credit card details.
    4. Confirmation:
      1. If payment is successful, you will see a message that payment has been completed.
      2. If your payment fails, you will be advised of this. Userve will not be advised why a payment has failed therefore you should contact your payment method provider for details.
      3. You will also receive an order confirmation by email.
    5. By using Userve’s online payment facilities you agree to all applicable Userve policies relating to your internet resources.
    6. All information that you provide on the payment facility forms will be handled in accordance with the Userve Privacy Policy.
    7. Userve may change the Purchase & Refund Policy for online payments at any time. Each transaction shall be subject to the specific Purchase & Refund Policy that was in place at the time of transaction.
  5. Other Terms and Conditions:
    1. Userve has no responsibility for any failure or error in online payment, including without limitation, any interruption, omission, mistake, malfunction or delay related thereto.
    2. Online payment will be operated and used at all times subject to applicable rules, laws, regulations and decisions of federal and provincial governmental authorities having jurisdiction.
    3. Any dispute related to online payment shall be resolved pursuant to the laws of British Columbia, Canada.
    4. Your use of online payments does not provide any legal right or interest in any intellectual property used in connection therewith, or any text or other content posted in connection therewith, including without limitation any copyright, for which all rights are reserved by Userve.
    5. Use of online payment is at your sole risk. Although Userve has endeavoured to create a secure and reliable service, the confidentiality or security of any communication transmitted or accessible over the internet cannot be guaranteed. Userve does encrypt your personal information on our systems and in transmission and complies with all applicable laws in handling such information. Accordingly, Userve and its affiliates are not responsible for the security of any information transmitted or accessed using the Internet. Actual or attempted unauthorised use of this online payment service may result in criminal and/or civil prosecution.
    6. Userve shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by Userve. No delay or omission on the part Userve in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.
    7. Userve reserves the right to change any terms and conditions of online payment at any time. Your use of online payment after any changes in such terms and conditions shall constitute your consent to such changes. You agree that Userve shall not be liable to you or to any third party for any modification, suspension, or discontinuance of online payment.

Refunds

  1. Userve will safeguard fees paid by participants/trainees.
  2. If a participant is dissatisfied with any part of the product being delivered then they will be eligible for a refund of 100% of any monies paid only if all of the following conditions have been satisfied:
    1. The refund request is submitted in writing within 7 days of purchase; and
    2. The participant has not yet completed the confirmation step required to get started with the product and/or begin the course; and
    3. The participant did not access the product through a free trial that was subsequently upgraded to a paid version.
  3. When a refund is approved, the refund payment will be paid within 14 days. Refunds are to be paid via electronic funds transfer back onto the payment method used for the original purchase.

Consumer Protection

This policy does not in any way limit the rights of participants to take action under Canada’s consumer protection laws.
